These Terms and Conditions (“Terms”) govern the use of our services provided by East Midlands Property Compliance (“we”, “us”, “our”). By booking or using any of our services, including Energy Performance Certificates (EPCs), inventories, check-ins, and check-outs, you agree to be bound by these Terms.
1. Definitions
- Client: The person or organisation booking our services.
- Property: The location where services will be carried out.
- Report(s): Any EPC, inventory, check-in, check-out, or documentation produced by us.
2. Our Services
We provide:
- Energy Performance Certificates (EPCs)
- Pre-tenancy and end-of-tenancy property inventories
- Tenant check-in reports
- Tenant check-out reports
All services are carried out with reasonable care, skill, and in line with industry standards.
3. Terms and Conditions – Booking & Access
3.1. All bookings must include accurate property information.
3.2. The Client is responsible for arranging access at the agreed date and time.
3.3. If we cannot gain access, the appointment may be classed as a failed attendance, and a 50% call-out fee will apply.
3.4. Properties must be safe, accessible, and suitable for inspection. We reserve the right to refuse service where conditions pose health or safety risks.
4. Pets & Property Access
4.1. All pets must be safely secured or removed from inspection areas throughout the appointment.
4.2. Pets must not have free access to any rooms or areas we need to inspect.
4.3. We are not responsible for securing, supervising, or containing pets.
4.4. If pets prevent or delay service, we may charge a failed attendance fee or reschedule at additional cost.
4.5. Any injury or damage caused by pets remains the Client’s responsibility.
5. Property Accessibility Requirements
To ensure accurate and complete assessments, the following areas must be fully accessible:

All accessible areas of the property, inside and out, must be clear, unobstructed, and reasonably safe to enter. This includes:
- All rooms, hallways, and cupboards.
- Outbuildings, garages, and sheds.
- Gardens, pathways, and external perimeters.
- Boiler locations and heating controls.
- Windows and doors.
5.2. Loft Spaces / Loft Voids
Where relevant (e.g., EPCs, inventories):
- Loft hatches must be accessible and operable.
- Any obstructions preventing safe ladder placement must be removed.
- Lighting, if present, should be functional.
If loft access is not possible, this may affect the accuracy of the report, and re-attendance fees may apply if a revisit is required.
5.3. Utility Meters
Electricity, gas, and water meters must be accessible for reading and inspection.
- Cupboards must be unlocked.
- Keys, access codes, or communal cupboard permissions must be provided.
If utility meters cannot be accessed, we may not be able to complete the service, and additional fees may apply.
6. Terms and Conditions – Fees & Payment
6.1. Prices will be confirmed at the point of booking.
6.2. Payment is due upon completion unless otherwise agreed in writing.
6.3. Reports may be withheld until payment is received.
6.4. Additional charges may apply for:
- Missed appointments or no access.
- Urgent or same-day bookings.
- Travel outside our standard coverage area.
- Properties with undisclosed additional rooms, outbuildings, or access issues.
- Re-attendance due to inaccessible areas, lofts, or meters.
7. Cancellations & Amendments
7.1. Cancellations or changes made within 24 hours of the appointment may incur a cancellation charge.
7.2. If we arrive and cannot complete the service due to unavailable access, pets, unsafe conditions, locked meters, or inaccessible lofts, full or partial charges may apply.
8. Reports & Accuracy
8.1. Reports reflect the condition of the property at the time of inspection.
8.2. Clients must review reports upon receipt and notify us of factual errors within 48 hours.
8.3. We are not liable for post-inspection changes or disputes arising after the inspection date.
9. EPC Specific Terms
9.1. EPCs are carried out in accordance with government legislation and assessment methodology.
9.2. EPC recommendations are advisory and not guaranteed to produce specific improvements.
9.3. Inaccessible areas or missing information may impact the EPC rating.
10. Terms and Conditions – Liability
10.1. We carry appropriate professional indemnity and public liability insurance.
10.2. We are not liable for:
- Losses due to inaccurate information supplied by the Client.
- Wear and tear or deterioration before or after inspection.
- Third-party decisions (landlords, tenants, agents, deposit schemes)
10.3. Our liability is limited to the cost of the service provided.
11. Client Responsibilities
Clients must:
- Provide accurate information during booking.
- Ensure full access to all relevant areas (internal, external, lofts, and utilities)
- Keep pets secured.
- Ensure systems such as lighting, boilers, and heating are operable (for EPCs)
- Remove hazards and maintain a safe environment for our assessors.

12. Data Protection & Confidentiality
We comply with UK GDPR. Data is used solely for delivering services and maintaining communication. We do not sell personal data and only share information where legally required.
13. Intellectual Property
All reports, photographs, and documents remain the property of East Midlands Property Compliance until paid for in full.
They may not be reproduced, modified, or distributed without permission.
14. Terms and Conditions – Complaints Procedure
Complaints should be submitted within 7 days of receiving the report. We aim to respond within 5 working days.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
16. Amendments
We reserve the right to amend these Terms at any time. The version applicable will be the one in effect at the time of booking.
